What
is OBC?
Other Backward Class (OBC) is a collective term used by the Government of India to classify castes which are socially and educationally
disadvantaged. It is one of several official classifications of the population
of India, along with Scheduled Castes and
Scheduled Tribes (SCs and STs).
How do I know if I belong to OBC or not ?
The above link will help you decide if you belong to BC (Backward
class) community. Further ,BC is classified into creamy layer and non creamy
layer. If you belong to Non creamy layer ,then you belong to OBC.
What
is Creamy layer ?
The term creamy
layer was first coined by Justice Krishna Iyer in 1975 in State of Kerala vs
NM Thomas case, wherein he observed that the benefits of reservation are
snatched away by the top creamy layer of the 'backward' caste or class, thus
keeping the weakest among the weak always weak.
They are not eligible for
government sponsored benefits in education and employment.
In UPSC, there are separate cutoffs for the General category
and OBC category .The cutoff of
the OBC category is slightly lower than the General Cutoff.
The candidates
belonging to creamy layer are taken under “General Category’
Please Note -The creamy layer is only applicable in the case
of Other Backward Castes and not applicable on other group like SC or ST.
Who belongs to Creamy layer ?
For children of persons in civil services, please note that the below
list belongs to creamy layer
Important Note –
- If you belong to creamy layer because of the above conditions ,you will continue to fall in creamy layer even after your parents retire from service.
- . YOUR INCOME/STATUS DOES NOT MATTER. Creamy layer is based on the status of your parents and has nothing to do with your income/status nor the status/income of your spouse.
- . Eligibility regarding government employee is based upon his level, and not his salary. Example –If your parents are earning 7 lakhs and they are below group B officers ,you will still come under ‘NON CREAMY LAYER.’

Hi, but there was a rule that if the applicant is a doc/engineer or such a professional, then the parent's income should be not more than 1 lakh per annum for the candidate to be eligible for nc. Is that true?

They simply rely on annual gross income of the family. If the candidate declares his/her income, that too is included for calculating the creamy layer limit.How to go about this? Because of this many genuine candidates are deprived of the opportunity.
further, many of the authorities are not aware of the fact that the creamy layer criteria is based on the status of the candidate's parents (if they are govt employees) and not by their income. Such a deep misunderstanding prevails all over. Even the forms they provide does not contain appropriate coloumns.
Sir, how to address this lacunae. It's a serious breach of govt guidelines, surprisingly by the govt officials themselves.

The candidates who are disqualified are children of Public/Private sector employees who have an annual salary of more than 6lakhs.

ReplyDeleteMy father's income from all sources (agriculture + private job) is less than Rs 6,00,000. I belong to the central list of OBC. At the time of filling UPSC CSE 2016 Prelims application form I did not have OBC certificate, so I applied as OBC (Creamy Layer).
Sir, do I still need to produce OBC certificate before UPSC at any stage since OBC (Creamy Layers) are regarded as general category candidates?
OBC Creamy layer candidates do not have to produce any certificate.
DeleteHello Sir, as per the last para (note 6) in chapter 2 of http://persmin.gov.in/DOPT_Brochure_Reservation_SCSTBackward_Index.asp document, where the scope of reservation is discussed, income from salary and agriculture will not be clubbed for the income/wealth test of sons and daughters of PSU employees. The income from sources other than above should not exceed 6 lac per anum as per this. Can you please confirm this and correct me if my understanding is wrong. Also, please share the real reason behind the disqualification of supposedly 120 candidates from the UPSC-2015 final list, if you have any pointers on the same?

DeleteI think that is one of the contentious issues right now because of which 35 of candidates from final list, who are also wards of PSU employees are not allocated any service. So, ideally the PSUs should've defined this with the help of related government authorities. As they haven't done it so far, the candidates may face disqualification. At the outset, this seems to be unjust as DoPT is taking action on these grounds for the first time.

I have an ITR of my father. He is Group- C employee (Teacher) with more than 30 year service. This year gross income is 6.15 lakh.
The person sitting there told me that I can't be issued OBC certificate as I fall in creamy layer. He only knows 6L is criteria.
I showed him relevant clauses which he hardly understands. (Group- C/III, Culmulative: 5.2L+5.8L+6.15L, Agri-Salary-Other Sources)He told the Revenue Inspector to whom he forwards doesn't allow certificates for income above 6L. Whom do I contact to make sure the issuing authority is made to understands the basic clause.
The worrying aspect is everyone nearby is showing less income by editing due to this. He asked me to do the same. I asked him to forward it with 6.15 L income.
Whom do I have to contact if RI doesn't not get the point? SDM or DM or anyone else?

ReplyDeletemy father retired from state govt service as DSP (by promotion) in 2014. he is a pensioner now and does not get FORM 16 that is income tax proof. Now if i submit his IT returns of 2014, 2013 and 12 in DAF will that suffice OR should i get his latest 2015 IT return filed? Please throw some light.

But the non creamy layer criteria in the army is applicable to those below the rank of colonel.the rank of a Lt.Colonel is one level below a Colonel. Do i then belong to the ncl of obc? ReplyDeleteI have given IBPS PO exam 2016.Now, i have an interview in january 2017 and i have an digitised OBC certificate having date 20/11/2015 ,so i want to know that is it valid for current financial year 2016-17 as authorities demand fresh certificate of current financial year for seeking employment in government jobs.Also, i went to Tehsildar and he told that digital OBC certificate made only once and there is no need to renew it but what to do if IBPS official do not accept my 2015 date certificate ,so please suggest me in this regard.
Sir, my father is a high school teacher (not Group A nor Group B with no attestation powers vested to him) but every time I go to the Sub Divisional Magistrate Office,in Durgapur, West Bengal , they say that your father earns more than Rs.6lacs as per Income Tax Form No.16 and not only they had rejected my OBC Proforma since April 2016 application several times but also used some insulting and inappropriate words. I felt helpless in this matter , and I told them that give in writing the reason for rejection of my OBC Proforma renewal form or I will take video footage of your misdeeds of harassing common peole like us, but is of no use. I also do not know the exact rules regarding Governments orders regarding OBC or am I not elligibe really? Sir, please help me in this fight with your valuable knowledge,support and guide me in the correct path whatever be it. thank you

As I have applied for civils in 2016 as obc category because I have certificate belonging to BCE provided by my state(ap),thasildar as I belong to BCE and that reservation was give by the state govt to SHAIKS. so I have applied as obc but later I checked the central list and came to conclusion that I belong to General category. So now iam in a confusion that should I apply as General category if I apply as general category guy will it make me any problem as my profile have been given as OBC so it is deceiving the upsc. So now Iam unable to understand what to do sir can u please suggest me any solution regarding this

Sir I belong to OBC category. To claim the benefits under OBC non creamy layer in UPSC what all certificates shall be produced.
Apart from the standard OBC certificate showing non creamy layer status, should I even have to produce any kind of wealth certificate separately again. If so whom to approach for the same.
No website is giving clarification on this.

1. My self is banker with salary of 8 lakh. my wife is also banker and earning 6 lakh. My mother is house wife and father is business man earning 3 lakh. Do I fall in Non Creamy Layer ?
2. My wife is banker and earning 6 lakh. Her father is LIC employee and earning 10 lakh from salary her mother is housewife.
3. After marriage my wife status will be of my cast or she will remain in her cast.
4. After marriage for parent income calculaton who will be considered as parents for my wife. father In law/mother in law or Father/mother.
5. Is state and center OBC certificate is different ?
please guide as I am not able to get answer of this from any one.
